Red Eye Media - Shop Maker Product License & Usage TermsRED EYE MEDIA - SHOP MAKER IS LICENSED SOFTWARE. PLEASE READ THIS DOCUMENT CAREFULLY BEFORE INSTALLING AND USING THE SOFTWARE. BY INSTALLING AND USING THE SOFTWARE YOU AGREE TO BECOME CONTRACTUALLY BOUND BY THE TERMS OF THIS LICENSE. IF YOU DO NOT AGREE TO THE TERMS OF THIS LICENSE, DO NOT USE THE SOFTWARE AND PROMPTLY DESTROY ALL COPIES. The supplied computer program(s) ("Software") is licensed, not sold, to you by Red Eye Media for use only under the following terms and Red Eye Media reserves any rights not expressly granted to you. You own the disk which has the Software recorded on it but Red Eye Media retains ownership of all copies of the Software itself. 1. Single Use License. This License allows you to have the Software installed only on a single computer at a time and allows you to use it only for a single shopping cart application or brand. Copies on more than one computer or more than one shopping cart or brand shall be deemed to be illegal copies and are in breach of both copyright and this License. Should you have a requirement for the Software to be on more than one computer, an additional Multi-computer License must be purchased from Red Eye Media. If you wish to move the Software from one computer to another, you must totally remove the copy from the computer on which it is installed and install it on an alternative computer provided once again that the Software shall not at any time be installed on more than one computer at any one time. You may make one backup copy of the Software in machine readable form; provided that such copy or the original may be used solely for backup purposes. The Software is protected by copyright law. As an express condition of this License, you must reproduce on the backup copy the Red Eye Media copyright notice and any other proprietary legends on the original supplied by Red Eye Media. 2. Restrictions. You may NOT distribute copies of the Software to others. In the event you are found to have provided copies to third parties, you agree to be liable to Red Eye Media for the full retail value of such copies. You may NOT rent, lease, loan, resell for profit, distribute, network, or create derivative works based on the Software or any part thereof. 3. Termination. This License is effective until terminated. The License will terminate immediately without notice from Red Eye Media if you fail to comply with any of its provisions. Upon termination you must destroy the Software and all copies thereof, and you may terminate this License at any time by so doing. 4. Warranty Disclaimer. This Software and the accompanying written materials are licensed "as is". The full text of the warranty is provided on the Shop Maker website (http://www.shopmaker.co.uk/productlicense.php) and in no event will Red Eye Media, or its developers, Directors, Officers, Employees be liable to you for any consequential, incidental, or indirect damage (including damages for loss of business profits, loss of data, business interruption, loss of business information, and the like) arising out of the use or inability to use the Software or accompanying written materials even if Red Eye Media or an authorized Red Eye Media representative has been advised of the possibility of such damages. Red Eye Media does not warrant that the Software will function properly in your particular environment. 5. Data integrity and backups. If we are hosting your site on one of our hosting plans or you are using our "Pay As You Go" service, we will endeavour to keep backups of your data in order to restore the server if we have a disk failure. However, we provide no guarantee that we will be able to do so. It is in your own interests to keep a copy of your web site backed up on your own computer. You can do this by simply uploading changes from a copy you hold or by using the backup tool provided in our hosting control panel. If you have an accident with your site we will do our best to help, but we may not be able to restore your files for you. It is impossible to have too many backups. Keeping a local copy at your location is the best way to protect your data. 6. Cancellation Rights. You, the shopper has the right to cancel within seven days of your contract, or seven days of receipt of the goods. If you do cancel your order, your payment will be returned in full.
